1. Definitions

In these Terms, the following definitions apply:

  • “We”, “Us”, “Our” means Kreatifart – Can Demirel, the provider of S services.
  • “You”, “User” means any individual or entity who uses or accesses the The Stratus services.
  • “Services” means the The Stratus WordPress plugin and any related services, including but not limited to translation, updates, support, integrations.
  • “Subscription” means a paid plan (monthly or annual) allowing you to use the Services under certain terms.
  • “User Content” means any content you upload, input or generate using the Services.
  • “Third-party Services” means services, APIs, plugins etc. not owned by us but integrated with or used together with The Stratus.

2. Acceptance of Terms

By accessing or using the Services, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with these Terms, you should not use the Services.

3. License Grant

  • We grant you a non-exclusive, non-transferable, revocable license to use the Services in accordance with these Terms and your Subscription.
  • This license is for your internal use only and is subject to payment of the applicable Subscription fees.

4. Restrictions

You agree not to:

  • Reverse engineer, decompile, or disassemble the plugin;
  • Modify, adapt, translate, or create derivative works of the Services except as allowed under your license;
  • Redistribute, resell, sublicence, or make the Services available to third parties beyond your license rights;
  • Use the Services for any illegal purpose or in violation of any applicable law;
  • Use the Services in any way that could harm, disable, overburden, or impair them.

5. Subscriptions, Billing, Renewals

  • Subscriptions are billed monthly or annually via Paddle, the Merchant of Record.
  • Subscriptions renew automatically at the end of each billing cycle unless you cancel before the renewal date.
  • We reserve the right to change pricing, but will notify you in advance (e.g. 30 days) of any price increase.

6. Refunds

  • You may request a refund within 7 days of your first payment, provided you have not used the Services in violation of these Terms.
  • No refunds will be provided after the refund period or for subsequent billing cycles unless otherwise required by law.

7. Intellectual Property Rights

  • All intellectual property rights in the Services, plugin, documentation, trademarks etc. belong to The Stratus / Kreatifart – Can Demirel.
  • You acquire only the right to use the Services as per your license; ownership remains with us.

8. User Content

  • You retain ownership of any content you upload or generate using the Services.
  • You grant us a non-exclusive, royalty-free license to use, reproduce, modify, and display user content as necessary to provide the Services (including backups, bug fixes, etc.).
  • You represent and warrant that you have all rights necessary for the content to be used as described, and that it does not violate any third party rights.

9. Termination

  • You may cancel your Subscription at any time through your account dashboard or by contacting us.
  • We may suspend or terminate access to the Services immediately if you violate these Terms.
  • Upon termination, your license ends. We may delete or anonymize your User Content after a certain period, unless retention is required by law.

10. Warranty Disclaimer & Limitation of Liability

  • The Services are provided “as is” and “as available”, without warranties of any kind, whether express or implied.
  • We do not warrant that the Services will be uninterrupted, error-free, or completely secure.
  • To the extent permitted by law, our liability for direct damages is limited to the amount you have paid us in the 12 months preceding the claim. We shall not be liable for indirect, incidental, special, consequential, or punitive damages.

11. Governing Law & Dispute Resolution

  • These Terms shall be governed by and construed in accordance with the laws of Turkey.
  • For Users located in the European Union (or any other country requiring consumer protection), if those laws provide mandatory protections, we will comply with such mandatory provisions.
  • Any disputes arising out of or related to these Terms shall be resolved in the courts of Istanbul, Turkey, unless otherwise required by applicable law.

12. Changes to Terms

  • We reserve the right to modify these Terms at any time.
  • When we make material changes, we will notify you (for example via email or via a notice in the Service) at least 30 days before the changes take effect.
  • Continued use of the Services after the effective date of any changes constitutes acceptance of those changes.
